  1. The Properties & Platform
    1. Welcome to Lekki Party Villas by Shortlethomes’ subscription Platform: www.Lekki Party Villas by Shortlethomes.net (‘Platform’). The Lekki Party Villas by Shortlethomes Platform is a product of and provided by Digital Landlords Limited (‘Digital Landlords ’). Digital Landlords is the owner of several luxury fully furnished terrace houses available for short let.
    2. These Terms and Conditions (‘Terms’) are between Digital Landlords /Lekki Party Villas by Shortlethomes (‘Lekki Party Villas by Shortlethomes’ ‘us’, ‘we’, or ‘our’) and a user who accesses or subscribes to the Platform or and used our properties (‘Guest’, ‘you’ or ‘your’). These Terms outline the terms and conditions of our relationship with you, as supplemented by our Privacy Policy. By using or subscribing to the Platform, you agree to be bound by the following terms and all applicable laws and regulations. These Terms and any relevant specific terms govern your use and access to the Platform.
    3. Lekki Party Villas by Shortlethomes reserves the right to modify these Terms at any time in at its sole discretion. You are encouraged to review the most current terms and any relevant specific terms each time you visit the Platform. Your continued use of the Platform after such changes are implemented constitutes your acknowledgment and acceptance of the changes. If you do not wish to be bound by these terms, do not use or access the Platform or use our Services.
    4. Your use or access of the Platform in any way signifies your constructive and actual notice and knowledge of, and your agreement to be bound by, the most current version of the Terms as posted on the Platform and our Privacy Policy. It is solely your responsibility to ensure that your use of any and all third- party Platform or content is in compliance with any and all third-party requirements.
  2. Eligibility to use the Properties & Platform
    1. InordertouseoraccessthePlatformorsubscribe/registerforourServices,you represent and warrant that you are at least 18 years of age and are legally able to enter into a binding contract.
    2. You authorize us, directly or through third parties, to make any inquiries we consider necessary to validate your identity.
  3. User Representation
    1. You represent, warrant and agree that no materials of any kind submitted through your Account or otherwise posted or shared by you through the Platform will violate or infringe upon the rights of any third party, including copyright, trademark, privacy, publicity or other personal or proprietary rights; or contain libellous, defamatory, fraudulent or otherwise unlawful material. You further agree not to collect email addresses or other contact information of other users from the Platform by electronic or other means for the purposes of sending unsolicited emails or other unsolicited communications. Additionally, you agree not to use automated scripts to collect information from the Platform or for any other purpose. You further agree that you may not use the Platform in any unlawful manner or in any other manner that could damage, disable, overburden or impair the Platform
  4. About our Party Villas (properties)
    1. Our Party Villas are furnished and equipped to high standards. From time to time, we may change the layout, furniture or fittings and we will try to update these on the Platform at the earliest opportunity and notify Guests if the changes to the properties change the nature of the accommodation.
    2. Differences between the description, photos on the Platform and those actually found at the property do not constitute a basis for cancellation, refunds or other claims against us. We will not be liable to Guests in the event of changes made to a property by us and not notified Guests.
    3. Internetconnectionisprovidedatourproperties.Thereisnochargefornormal use of this facility. If a loss of internet connection occurs, we will endeavour to get you reconnected as quickly as possible but we cannot be held liable for any losses resulting from the loss of internet connection.
    4. Unlessotherwisespecified,thepricesquotedforallservicedpropertiesinclude utilities.
  5. Bookings and payments
    1. Bookingswillwarrantaminimumdailyrateof___________________.
    2. Bookings are strictly for get-togethers/hangouts, birthdays, small events, small celebrations, video shoots, photoshoots with no more than 75 guest per unit. More than 75 guest at a time will warrant a minimum daily rate of ₦50,000.00 per guest and capped at 100 guests. Going beyond 100 per guest will warrant an instant cancellation of your booking with no refund.
    3. Photoshoots and video shoots will warrant a _____________ daily rate limited to 20 guest and a daily charge of N50,000 per guests for over 20 guests.
    4. A booking is not confirmed until you receive a confirmation from us. A pre- payment of 60% of the rental price is payable on booking and confirmation will not be in effect until the whole of the pre-payment has been received. The balance of the rental price must be paid 48hrs before check-in and non- payment of the balance by the due date will constitute a basis for cancelling your booking and the application of the cancellation conditions with no refund if cancellation made outside of cancellation terms stated in this agreement.
    5. All bookings are exclusive of VAT and you must pay 7.5% VAT on your daily rates.
  6. Cancellation and modification of booking
    1. Any cancellation or modification of a booking can only be effected by the Guest providing a written notification of the cancellation or modification to Lekki Party Villas by Shortlethomes. The non-payment of rental balances results in automatic cancellation.
    2. Should the Guest for whatever reason cancel the booking, they will have the right to reimbursement of all monies paid subject to the deduction of cancellation charges being 30% of the total rental price if cancellation is made 14 days prior to the guest checking in. After 14 day to the event we can offer no refund.
    3. Changes to booking dates or properties are subject to availability. Each booking change shall incur a service fee of 25% to be paid at the time of confirming the said changes.
    4. Cancellations cannot be made less than day to your bookings. All booking payments are also non-refundable after the guest has checked-in.
    5. If we cancel a confirmed booking due to health and safety reasons, we shall do our utmost to find a suitable date for the Guest, a refund cannot be made for health and safety reasons.
    6. The Guest agrees and acknowledges that in this event, Lekki Party Villas by Shortlethomes’ liability for damages will be limited to the amount of unused rental, based on a pro rata calculation of unused rental days. Should a property become unserviceable prior to the arrival of a Guest, We will do our best to find a suitable replacement property of an equal standard. In the event of a more expensive property being selected, the Guest will have the choice of paying the difference or receiving a full refund of monies paid provided it’s not due to health and safety reasons.
    7. The rules for check-in and check-out are set by us. All properties are usually available for occupation after 2:00 pm on the day of arrival. All properties must be vacated by 11:00 am on the day of departure. If there is any delay in vacating the property beyond the agreed time a full day’s rental is charged to the Guest.
  7. Security Deposit and Property Damage
    1. A refundable security deposit of ₦250,000.00 shall be required by Lekki Party Villas by Shortlethomes.
    2. Allsecuritydepositsarefullyrefundableprovidedtherearenodamagestothe booked Lekki Party Villas by Shortlethomes property by your chosen guest and rules are not broken.
    3. In the event that a guest damages an item, multiple items or damages the property, the guest forfeits the deposit paid and the guest is liable to cover cost of up to ₦2,500,000 damages or more equating to the cost of replacing the damaged item(s) or damaged property as stipulated by Lekki Party Villas by Shortlethomes.
    4. The security deposit shall be refunded within 2 working days of you or your guest’s departure.
    5. Wehavetheauthoritytowithholdordeductmoniesfromthesecuritydeposit or credit card to remedy any damage, excess cleaning, missing items, excess utilities caused by the Guest or to send an invoice for such monies to the Guest by email for immediate payment.
    6. Aguestmaynotremoveanyofthefurnitureoreffectsfromthepropertiesand will be liable for any furniture or effects damaged or missing from the properties. Furniture must be returned to its original position.
    7. Our representatives and subcontractors have the right of access to the property at any time, with due regard to your convenience, for the purpose of inspection of the properties and to carry out any essential repair or maintenance work.
    8. Our Security representatives and subcontractors have right of access into the property at any time, regardless your convenience, for the purpose of inspection of the properties and executing our emergency and security protocol.
    9. OurSecurityrepresentativesandsubcontractorsshallconductrandomcall-ins and check ups to the apartments booked and any missed call will automatically effect an Emergency and Security protocol.
  8. Conduct of Guests
    1. Allguestsmustprovideproofofidentificationbeforecheck-insspecificallyNIN (National Identification Number), Voter’s Card and International Passport.
    2. Driver’s License and other means of identification not listed in 8.1 above will not be accepted as a valid means of identification/check-ins
    3. False or suspected to be false means of identification will be subjected to automatic eviction of the user without refund.
    4. Smokingofcigarettes(E-cigarettesinclusive),marijuanaarenotallowedinside the apartment/property and if discovered will be subjected to automatic eviction and contract termination of the user without refund with an additional fine of ₦250,000.00 for marijuana, ₦200,000.00 for cigarettes to cover the cleaning of curtains and carpets and to replace items with burns respectively.
    5. Allsmokingmustbedoneoutsidetheapartment/property.
    6. Smokinginapartment/propertybalconiesisprohibited.
    7. All accommodation must only be used for private small event use only. The maximum number of guests allowed is 75 per villa except as otherwise agreed by Lekki Party Villas by Shortlethomes in writing before you or your guest checks in.
    8. No functions get togethers or gatherings where occupants of neighbouring apartments might be disturbed will be conducted at the property under any circumstances unless agreed by Lekki Party Villas by Shortlethomes in writing before you or your guest checks in.
    9. Exceedingthenumberofallowedguestswillresultinautomaticterminationof booking and you being required to vacate the property immediately without refund unless already agreed in writing by Lekki Party Villas by Shortlethomes.
    10. You must leave our properties in a clean and tidy condition. You must also comply with the By-Laws that apply to the properties and shall not be guilty of conduct which is a nuisance or annoyance to adjoining or neighbouring occupiers. In the event that the property requires deep cleaning as a result of your stay, you will be charged an additional ₦250,000.00 and you forfeit your deposit.
    11. No pets are allowed inside the accommodation under any circumstances. Any pets found inside the properties will result in a termination of your booking without refund.
    12. We adopt a fair usage and moderate noise policy where neighbouring residents are the determinants of this policy. In the event where a neighboring resident request noise reduction, all guests must oblige of face booking cancellation with no refund.
    13. We have the right to terminate a booking at any time on the grounds of breaking the agreement within this terms or the abuse of these terms including being a nuisance to staff, residents or other guests, mistreatment of the property or criminal activity on the part of those occupying the apartment or their guests. No refunds are made in the event of this happening.
  9. Suspension of the Platform
    1. We do not guarantee that our Platform will always be available or be uninterrupted. We may suspend or withdraw or restrict the availability of all or any part of our Platform for business and operational reasons.
  10. Emergency and Security Protocol
    1. Where it is discovered that the user has breached any provisions of this agreement intentionally or otherwise, we shall require our Security representatives and subcontractors the automatic right of access into the property at any time to ensure order and safety.
    2. All matters regarding property damage, threat to life or any fundamental right violation from the conduct of the user will result to the intervention of the Nigerian Police through our security representatives and subcontractors with submission of Collateral for such damage where fit.
  11. Disclaimers
    1. We do not promise that the Platform or property or any content, service or feature of the Platform or property will be error-free or uninterrupted, or that any defects will be corrected, or that your use of the Platform will provide specific results. The Platform and its content are delivered on an “as-is” and “as- available” basis. All information provided on the Platform is subject to change without notice. We cannot ensure that any files or other data downloaded from the Platform will be free of bugs or viruses. We disclaim all warranties, express or implied, including any warranties of accuracy, non-infringement, merchantability and fitness for a particular purpose. We disclaim any and all liability for the acts, omissions and conduct of any third Get togethers in connection with or related to your use of the Platform. You assume total responsibility for your use of the Platform.
    2. Excepttoextentwithinitscontrol,LekkiPartyVillasbyShortlethomes/DLNLshall not be liable for any bodily injury, death or loss or damage to any property belonging to the Guests, invitees or any other person in or about on the premises of its Third party rental apartments and in no event shall Lekki Party Villas by Shortlethomes/DLNL be liable for any consequential injury, death, economic or financial loss or damage relating thereto. This only relate to Third party rental apartments. Third party rental apartments are the apartments not on the direct management of Lekki Party Villas by Shortlethomes/DLNL.
    3. Guests acknowledge that they are not under any obligation to accept the offer to be transferred to a Third party rental apartment.
  12. Limitation of Liability
    1. Under no circumstances shall we be liable to you for any indirect, consequential, exemplary, incidental or punitive loss or damages arising from your direct or indirect use of the Platform.
    2. Guests acknowledge that they are responsible for taking all necessary safety precautions for themselves and their guests and neither Lekki Party Villas by Shortlethomes accept any liability for accidents causing death, sickness or bodily harm howsoever caused. Digital Landlords and Lekki Party Villas by Shortlethomes deny any liability or claims in the event of incidents occurring whilst occupants or guests are under the influence of alcohol or drugs. The limitation of liability for any claim against us is limited to the total amount of rental paid to us by the Guest.
    3. We will not be liable for any delay, loss, damage or expenses incurred if your booking needs to be altered or cancelled or we are unable to perform our contractual obligations as a result of events beyond our reasonable control, which shall include but not be limited to events such as war, civil strife, terrorist activity, labour disputes, natural or man-made disaster, fire, flood, and adverse weather conditions
  13. Waiver and Severability
    1. Our failure to enforce a provision of these terms is not a waiver of our right to do so later. If any provision of these terms is found invalid or unenforceable by any court of law, the invalidity or unenforceability shall not affect the validity or enforceability of the remaining provisions of the terms, which will remain in full effect and an enforceable term or terms will be substituted reflecting our intent as closely as possible. No waiver of any of these terms shall be deemed a further or continuing waiver of such term or condition or any other term or condition.
  14. Governing Law
    1. All matters or disputes relating to your access to or use of the Platform, or arising from the booking of accommodation with us, will be governed by the laws of The Federal Republic of Nigeria and the Nigerian Courts shall have exclusive jurisdiction to determine such disputes or matters.
