Giwa Gardens Liability Waiver

By purchasing Giwa Gardens Water Park tickets, in consideration of being allowed to use the facilities and attractions of the water park, you and the family members or friends you bring along, agree to the following: 
 

1. You understand and acknowledge that using the park’s attractions involves certain risks, including but not limited to the risk of injury, illness, or death.
2. You understand and acknowledge that the park has taken reasonable measures to ensure the safety of its attractions, including the presence of qualified lifeguards and other safety measures.
3. You acknowledge that I am responsible for my own safety and the safety of any of the children in my care.
4. You hereby release and discharge the park, its owners, employees, and agents from any and all claims, demands, causes of action, damages, or liability arising out of or in connection with my use of the park’s facilities and attractions, including but not limited to any injury, illness, or death.
5. You agree to indemnify and hold harmless the park, its owners, employees, and agents from any and all claims, demands, causes of action, damages, or liability arising out of or in connection with my use of the park’s facilities and attractions
6. Giwa Gardens, acting reasonably at all times, reserves the right, to refuse admission to the waterpark, ban from entry to the Waterpark, or remove from the Waterpark without any right to a refund any person whose presence or behaviour may affect the enjoyment and/or safety of other guests or staff or who: acts in an inappropriate and/or undesirable manner.
7. Giwa Gardens reserves the right to initiate legal proceedings or prosecute any person who: is found damaging or defacing any part of the grounds, fences, barriers, walls, ride structures, exhibits, fabrics, or buildings at the Waterpark; or has displayed any sign or visible representation of any kind which is or could be reasonably judged to be, threatening, abusive or insulting; or has previously acted in any manner which has caused any person to report that individual to Giwa Gardens; or is attempting to regain admission to the Waterpark or has been found inside the Waterpark without a valid ticket.
8. Unnecessary noise or any behaviour likely to cause annoyance to other guests or confusion of any kind is not permitted in any part of the Waterpark. Smoking (including of e-cigarettes) is strictly prohibited other than in the designated smoking areas identified on the park map.
9. Vehicles are parked at the owners’ risk. Giwa Gardens take no responsibility for damage caused to any vehicle using the car park and no guarantee is given as to the security of guests’ vehicles in the car park or any contents. A parking fee may apply.
10. Pets of any nature are expressly prohibited in the Waterpark.
11. Unless it is expressly prohibited, you are permitted to take photographs and recordings within the Waterpark if these are solely for private use and are not sold or used for any commercial or public purpose. You are prohibited from taking photographs and/or recordings whilst on any ride and/or waterpark. Please note that harnessed or fixed cameras including, but not limited to, GoPro or similar brands are not allowed on any ride and/or waterpark in any circumstances. By accepting these Entry Conditions, you acknowledge that Giwa Gardens may request access to photographs taken and video footage captured by you. If they are deemed to be offensive to or infringe the privacy of other guests and/or staff Giwa Gardens will request that they are deleted.
12. From time-to-time Giwa Gardens or other authorised parties carry out photography and/or video recording in the Waterpark, which may feature guests. Entry to the Waterpark is deemed acceptance of these Entry Conditions, and you therefore agree that Giwa Gardens or any authorised party may use such images in perpetuity in any promotional, advertising or publicity material in any format whatsoever.
13. You further agree that copyright in these materials rests with Giwa Gardens or such authorised party (as the case may be).
14. Giwa Gardens Water Park takes its reputation and integrity very seriously. You agree not to make any false, misleading, or defamatory statements about the Waterpark, its owners, operators, directors, employees, agents, or affiliates, either verbally or in writing, on any platform or medium, including but not limited to social media, blogs, websites, reviews, or videos.
15. You acknowledge that such statements may cause serious harm to the reputation and business of the Waterpark and that the Waterpark reserves the right to take legal action against you for any damages, losses, or expenses resulting from your defamation. You also agree to cooperate with the Waterpark in removing or retracting any defamatory statements that you have made or caused to be made.
16. By entering the Park, you agree not to engage in any conduct that could harm the Waterpark’s reputation or the reputation of its owners, directors, employees and agents. The Waterpark reserves the right to take appropriate legal action to protect its interests and maintain the positive image of the Waterpark.
17. You also acknowledge that the Park is not responsible for the content of statements made by other visitors to the Waterpark, and any disputes arising from such statements shall be resolved between the parties involved.
18. You are encouraged to exercise caution and honesty when expressing opinions or sharing information relating to the Waterpark. You are also encouraged to use common sense and discretion when making any statements about the Waterpark online or in public.
19. If you have a concern about the Waterpark, we encourage you to contact us directly so we can address it appropriately.
20. You acknowledge that you have read and understand the Waterpark’s terms and conditions of use, and agree to comply with them.
21. You agree that this waiver shall be binding upon you, your heirs, executors, administrators, and assigns.
